Welcome to HeartLink. These Terms of Service ("Terms") govern your use of HeartLink products and services operated by DigitalBits (Pty) Ltd ("DigitalBits", "we", "us", or "our").

By purchasing, activating, or using HeartLink, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our products or services.

HeartLink is a physical NFC-enabled product that allows paired users to send notifications ("hugs") to each other. Each HeartLink set consists of two paired devices designed to work together.

You must be at least 18 years old to purchase HeartLink. By making a purchase, you represent that you are of legal age to form a binding contract.

3. Orders and Payment

All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in pricing or product information, or suspected fraud.

Payment must be made in full at the time of purchase. We accept payment via the methods displayed at checkout (including card payments via Yoco, instant EFT via Ozow, and manual EFT).

Prices are quoted in South African Rand (ZAR) and include VAT where applicable.

4. Delivery

We offer delivery within South Africa. Delivery times are estimates and not guaranteed. We are not responsible for delays caused by courier services or circumstances beyond our control.

Risk of loss passes to you upon delivery to the shipping address provided. Please ensure your delivery address is accurate and complete.

HeartLink, including all related trademarks, logos, designs, and content, is the property of DigitalBits (Pty) Ltd. You may not copy, modify, distribute, or create derivative works without our express written permission.

9. Limitation of Liability

To the fullest extent permitted by South African law:

You agree to indemnify and hold harmless DigitalBits (Pty) Ltd and its officers, directors, and employees from any claims, damages, or expenses arising from your use of HeartLink or violation of these Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts.

12. Consumer Protection

Nothing in these Terms affects your statutory rights under the Consumer Protection Act 68 of 2008 (CPA) or any other applicable consumer protection legislation.

13. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Continued use of HeartLink after changes constitutes acceptance of the new Terms.
